Myriad can patent breast cancer genes: US court (AFP)

WASHINGTON (AFP) ? A US federal appeals court on Friday ruled in a landmark case that a Utah-based company is allowed to keep its patent on two genes linked to an inherited form of breast cancer.

The ruling overturns a lower court's decision and allows Myriad Genetics to maintain its patent on the isolated genes, known as BRCA1 and BRCA2, despite complaints from rights groups who say it creates an unfair monopoly and limits women's health choices.

The US Court of Appeals for the Federal Circuit decided such patents on isolated DNA molecules could be held, in accordance with the "longstanding practice" of the Patent and Trademark Office (PTO), over the past 29 years.

The 2-1 court ruling also said the company cannot patent five broadly framed processes of comparing or analyzing DNA sequences because they were "abstract mental processes."

However, a Myriad spokeswoman said that aspect of the ruling did not hurt the company's ability to test for the isolated genes.

"Our intellectual property position today is no different than before the ACLU even brought this case," Rebecca Chambers, head of investor relations with Myriad, told AFP.

She said the company still has 232 method claims, or steps that explain exactly how to test, "as part of 23 patents which describe how we go about doing the BRAC analysis test that were not even part of this lawsuit."

Backed by pharmaceutical company Eli Lilly, Myriad obtained US patents in the mid-1990s on two genes -- BRCA1 and BRCA2 -- strongly associated with hereditary forms of breast and ovarian cancer in women.

According to the National Cancer Institute, 12 percent of women in the general population will develop breast cancer in their lifetimes, compared to 60 percent of women who have inherited a mutation in BRCA1 or BRCA2.

With ovarian cancer, 1.4 percent of women may be diagnosed in their lifetimes but the number rises to 15-40 percent of women with the BRCA1 or BRCA2 mutation.

The patents held by Myriad mean the company owns the "exclusive right to perform diagnostic tests on the BRCA1 and BRCA2 genes and to prevent any researcher from even looking at the genes without first getting permission from Myriad," the American Civil Liberties Union said in a statement.

A key complaint in the lawsuit, was filed in 2009 by a coalition of patient advocacy and medical groups represented by the ACLU, was that the company wielded too much control over the tests and costs.

The plaintiffs had argued that the company was claiming an "illegal monopoly over products of nature, laws of nature and/or natural phenomena, and abstract ideas or basic human knowledge or thought," the ACLU said in a statement.

ACLU lawyer Sandra Park told AFP: "Myriad's monopoly on the BRCA genes makes it impossible for women to access alternate tests or get a comprehensive second opinion about their results. It also allows Myriad to charge a high price for its tests."

The ACLU was consulting with its clients and would make a decision soon about whether to appeal to the full 12-member court of appeals for the federal circuit or to bring the matter before the Supreme Court, she said.

Analyst Robert Cook-Deegan of the Institute for Genome Sciences and Policy at Duke University in North Carolina, said he expected the legal battle would continue over whether human DNA is something that can be patented and owned.

"This is probably not the last stage in this game," he said. "The fact that all three judges have given very different lines of reasoning does suggest to me that there is going to be another round to go here."

If the matter reaches the Supreme Court, he said the outcome would be "very unpredictable."

Biotech companies first began patenting genes and genetic material in the 1980s. More than 20 percent of the 24,000 human gene patents granted since then have been in the United States.

A gene inside the human body cannot be patented. But once it is identified, removed and isolated, a company can apply for exclusive rights to exploit it for commercial purposes.

Only a handful of countries -- including Brazil and Chile -- do not allow patents on genes in any form.

The simplest way of telling a story is through the voice of a storyteller. This may be in an anonymous voice, a companionable voice or an authorial voice. Modern novelists let the facts about a character emerge slowly and are often conveyed by action and speech. Letting the character develop slowly through your writing allows the reader to develop their opinion of the characters actions.

Book Review: The Summer I Turned Pretty by Jenny Han

Belly measures her life in summers. Everything good, everything magical happens between the months of June and August. Described as the perfect summer book it had to be really, didn?t it? And it is indeed a good book to enjoy on a lazy summer afternoon, with it?s beach setting, where you can almost feel the sting of sand and smell of sea and short easy chapters that keep you turning pages effortlessly. In a short authors note at the beginning of the book, Jenny Han says 'I truley Believe in every girls life there is that one golden summer' and I shouted yes! There is. I had it and remember it fully. Han perfectly captures that magical moment where you are no longer a child, where the summer stretches endlessly before you and anything is possible. The setting is wonderful, who wouldn?t want to spend every summer at a beach house?I know when I was a teen this book would have been my idea of heaven. Belly has been spending summer here her whole life, with her mother, elder brother Stephen and her Mums best friend Susannah and sons Jeremiah and Conrad. Lucky!But there?s more to The Summer I Turned Pretty than I originally imagined and the story isn?t just about this one summer, but many summers where we learn just how deep and complex the relationship between the two families are. There?s quite a serious side to this book which I wasn?t at all expecting but was covered very well and enhanced the importance of this Summer perfectly. The relationships between the characters are drawn very well, from the bickering between Belly and her brother, the exclusion she feels from ?the boys? and the awe she feels for older and more serious Conrad.Jenny Han's writing is very atmospheric, evoking vivid images of the beautiful setting and is incredibly easy to read. However I did have a couple of issues with the book, mainly involving main character Belly. I didn?t love her that much, she?s stroppy and self-absorbed believing the whole world revolves round her. She has a ?poor me? attitude at times which isn?t warranted and fails to see what?s happening to those she purports to care about.? I thought a book, which had the potential to be outstandingly good, was ruined by her attitude. That?s not to say overall I thought the book was bad, it?s really not. However I was sad I couldn?t fully love it because of my feelings toward her. ?The publisher?s blurb hints at a love triangle and there is, kind of, but not the one I was expecting. Again this didn?t do much for me, and left me wondering about the point of it at times. ?So would I recommend The Summer I Turned Pretty? Weighing everything up I still say this is worthy of making your summer reading list. I managed to read this in one very easy sitting, the chapters are just a few pages long meaning I kept thinking ?one more? and ended up finishing the book very quickly. And by the end, Belly had redeemed herself a little in my eyes ? I just wish we?d seen more of this side of her and less of the rest. It also left me wanting to catch the second book in the series; It?s Not Summer Without You. I?d say this was a satisfactory read, not perfect but certainly not a terrible way to spend a few hours on the beach.?

Sino-Forest delays tour of its assets; shares dive (Reuters)

TORONTO (Reuters) ? Embattled Chinese forestry company Sino-Forest said on Wednesday it has postponed a tour of its forestry assets because many analysts have halted coverage of the company.

The value of Sino-Forest shares and bonds collapsed last month after short-seller Muddy Waters accused the company of fraudulently exaggerating the size of its forestry assets.

The company has denied the allegations and appointed an internal committee of its independent directors to investigate the matter. However a full review is expected to take up to three months to complete.

Dundee Capital Markets analyst Richard Kelertas and RBC Capital Markets analyst Paul Quinn, who initially panned the Muddy Waters allegations, later opted to suspend coverage of the company. Other analysts have put their ratings and price targets on Sino-Forest under review.

"Following management's recent conversations with the analyst community who cover Sino-Forest, it has become apparent that many of you have been precluded from resuming coverage of the company and otherwise discussing its affairs publicly until after the independent committee reports," the company said in in a letter announcing the postponement.

The move to postpone the tour doesn't help Sino-Forest's stock, said Barry Schwartz, who is vice president and portfolio manager at Baskin Financial Services in Toronto.

"The company has not done a great job defending itself," he said. "There's too much uncertainty until the auditors come and pick through the company."

Investors reacted negatively to the company's move, driving Sino-Forest's shares down more than 20 percent to C$4.16 in early trading on the Toronto Stock Exchange. The shares pared some of the early losses ended the day down 10.2 percent at C$4.75.

"We do apologize for this change of plans and hope you understand the circumstances that required this change," said Sino's chief executive, Allen Chan, in the letter addressed to analysts and investors.

Sino-Forest had proposed to organize the tour in mid-July, in an attempt to calm investors who fled the stock in light of the Muddy Waters report, which was issued on June 2. The company did not provide a new date for the tour, but indicated that it does plan to reschedule it.

"We look forward to rescheduling this trip and providing you with an opportunity to speak with management, customers, suppliers and forestry bureaus," Chan said.

Chris Damas, an independent analyst and investor, said he understands why Sino-Forest would decide to postpone the tour.

"The analysts on the street were probably hesitant to go over to China because at this point they're skeptical about the degree or granularity of information they'll get in China," he said.

Damas said the current level of volatility in the stock indicates that it is trading more on sentiment than on fundamentals. "I'd be trading it, but I just don't have that kind of desire to spoil my summer," he said.

The Sino-Forest announcement comes a day after the Ontario Securities Commission, Canada's main securities regulator, said it is conducting a targeted review of companies listed on markets it covers that have a major portion of their business operations in emerging markets.

The OSC has stated that it is investigating the Sino-Forest matter specifically, but it has declined to provide further details.

The securities regulator in the province of British Columbia said it is also keeping tabs on developments in the Sino-Forest case.

"I can say that on the controversy related to Sino-Forest, we've had a look at some of our existing assessment tools that we use for looking at companies that are trading to see if there are any lessons to be learned," said Martin Eady, who is director of corporate finance at the BC Securities Commission.

"We're certainly open to make adjustments if necessary based on the outcome of any reviews that happen," he said.

Shares of Sino-Forest, which fell as low as C$1.29 at one point in June, had closed at C$5.29 on Tuesday on the Toronto Stock Exchange. The stock is down more than 75 percent since the beginning of June.

Last Vietnam-era draftee is retiring from Army (AP)

FORT BELVOIR, Va. ? A homemade wind chime with the word "Whining" under a red slash is made from metal parts put in his leg after a parachute accident. Every Sunday he trims his crew cut. He didn't join the Army willingly, but as Command Sgt. Maj. Jeff Mellinger prepares to retire, he's grateful he found his calling.

Mellinger was drafted to fight in the Vietnam War, and the Army believes he's the last draftee to retire, after 39 years. Most did their two years and left. But Mellinger had found home.

"I think I'm pretty good at it, but I like it. That's the bottom line. I love being a soldier and I love being around soldiers," he said.

Mellinger's motto is simple: No whining ? as the wind chime attests.

When the draft notice arrived in the mail in 1972 at his home in Eugene, Ore., tens of thousands of troops had been killed. Anti-war protests were rampant. Draft cards were being burned and returning soldiers were treated as part of the problem. The military wasn't a popular job.

The return address on the letter was the White House. Just 19, he was impressed that President Richard Nixon would write to him.

"I opened it up and it said, `Greetings from the president of the United States.' I said, `Wow, how's he know me?'" Mellinger said, laughing. "It was a form letter that said my friends and neighbors had selected me to represent them in the Armed Forces and I was hereby ordered to report for induction."

Mellinger told the draft board there was a mistake.

"I ... told them I don't need to go into the Army, I've got a job," said Mellinger, who hung drywall for a living. "They just kind of laughed."

Once the path was set, he said, he didn't consider trying to find a way out.

He heard so many war stories in training that he was fired up about going, and was disappointed he was instead assigned to be an office clerk in Germany.

In Germany, Mellinger immediately stood out with his positive attitude, short haircut and mastery of physical fitness skills, said Bob Myers, 64, of Pleasant Hill, Iowa, then his company commander who now runs a chain of convenience stores. He replaced a soldier in trouble for illegal drug use, Myers said.

"He wasn't a part of that culture and everyone knew that," said Myers, who was instrumental in getting Mellinger to enlist when his draft term was over.

Mellinger wasn't long for clerking. He earned a spot in the Army Rangers, and would go on to do more than 3,700 parachute jumps. And despite the 1991 parachute accident that gave him the material for the wind chime, breaking his leg in several places, he went on to run nine marathons. He was made a command sergeant major in 1992.

Nearly a decade later, he was sent to ground zero in New York right after the Sept. 11, 2001, terrorist attacks as part of an advance party from the First Army. Then came his time in Iraq as the top enlisted soldier of the multi-national forces in Iraq, where he says he survived 27 roadside bombings during his deployment of nearly three years straight.

Mellinger, 58, says his stories of being in the Army during the tumultuous 1970s as the Army struggled with issues of drugs, race and the role of women are so foreign to young troops that they look at him like he's a dinosaur when he shares them.

A recruiting poster hanging today on Mellinger's office door at Fort Belvoir, where he's the command sergeant major for the Army Material Command, that encourages female troops to try out for female engagement teams that work in war zones with Special Forces troops shows just how much things have changed since Mellinger was drafted.

Until 1978, female troops were in the Women's Army Corps separate from the regular Army. Mellinger said he recalls when most female troops weren't allowed to carry weapons and were taken out of the field at night to sleep in a separate barracks away from the men.

"There were some stymied leaders. What do we do with all these females?" he said. "A lot of those things together caused a lot of turmoil, caused a lot of difficulty and problems and a huge leadership challenge because the military was being torn apart like the country was."

Mellinger understands well the tragic side of soldiering. He knows 40 to 50 people buried at Arlington National Cemetery and goes to Walter Reed Army Medical Center to visit wounded troops and their families most weekends he's in town.

It was in a hospital room in 2009 that Jill Stephenson met Mellinger, who was standing near the bedside of her son, Cpl. Benjamin Kopp, 21. Mellinger had heard that Kopp, a fellow Ranger, had been shot in Afghanistan and he went to see him. Mellinger immediately embraced Stephenson, she said.

"It was the most compassionate, caring hug around me that I ever have received from a stranger. It was very comforting," said Stephenson, 44, of Rosemount, Minn.

Kopp died soon after. Stephenson has since stayed with Mellinger and his wife, Kim, on multiple occasions while in Washington to attend ceremonies at Arlington cemetery, where her son is buried.

Several soldiers who served directly under Mellinger in Iraq have reached out to him to talk about their combat-related mental health issues. One was a soldier who rang his doorbell and said he was haunted by the memory of helping to collect the remains of a fallen Marine, and he was bothered that he didn't know the Marine's name.

"I told him his name and we sat and talked for several hours," Mellinger said.

Mellinger said he has a roster with the names of the 2,614 troops killed, the 19,304 wounded, and two missing in action from his time in Iraq. He wears a metal bracelet with those numbers sketched in it in their honor.

Mellinger's happy with the set-up of today's all-volunteer force, but he does think the contributions of draftees have been forgotten, particularly since there's such a romantic notion that after the bombing of Pearl Harbor in World War II, everyone "ran down to the recruiting station." In reality, thousands were drafted in that war and many others, he said.

"Draftees are pretty maligned over time," he said, "but the fact is they are part of every branch of service up to 1973, and when you look at what those military branches accomplished over time, I'll let the record speak for itself."
